Ballfinder Terms

1. Confirmation of your order:
We reserve the right to restrict the number of products that may be purchased at any one time and even refuse to accept any order. Payment must be made in full including postage and packaging before any order can be confirmed and or accepted.

We will confirm your order by return to the email address provided, however this is an automatic service and does not mean your order has yet been accepted only when we have confirmed your order by email or the goods have been delivered will a binding contract be created between us.


2. Prices:
All the prices set out in our web site are in pounds sterling and include UK duties were applicable. Any orders dispatched outside the UK are the responsibility of the purchaser to the payment and disclosure of all taxes and duties that apply in the country to which the products are dispatched. All our prices are listed on our web site and include postage and packing these prices will remain fixed until new rates are set and posted to the web site.

Whilst ever endeavour is taken to ensure that all prices on our website are accurate, mistakes can sometimes occur. If a mistake is discovered in the price of products you have ordered we will contact you as soon as possible to give you an option of either reconfirming your order at the correct price or to cancel it. If we are unable to contact you we will treat the order as being cancelled. If the order is cancelled, we will refund any money which we have taken from you.


3. Stock Levels
All orders are subject to available stock levels. If goods you order are not available at time of ordering we will notify you where possible if we have received the price and the delivery charges of the unavailable products, we will refund them to you within 30 days of your order unless you decide to wait for new stock to arrive.


4. Delivery
We will attempt to deliver all UK orders within 4 working days from receipt of confirmation of your order and cleared payment. Addresses outside the UK will be subject to a further 5 days due to other services beyond our control it may take up to 28 days for delivery. The products will only become the property of the purchaser once they have been delivered to the requested address then all liability will pass to the purchaser. Any products returned from ordered addresses will be subject to all postage and packaging charges and will include a 10% administration charge and the balance will be refunded.

Actual products delivered may vary from products shown on this web site. We reserve the right to change the product supplied without notice.


5. Cancellation:
Once a product has been delivered you have 7 days after the day you received the product in which to cancel without having to give any reason however you will be expected to keep the goods in reasonable condition until returned to use by recorded delivery. If the product is defective or damaged we will replace or refund all charges including all delivery costs. Goods must be returned in there original packaging and carefully packed. You must provide us with the original invoice or some other form of proof of purchase. This in no way effects your consumer statutory rights

For products to be returned they must be addressed to, Ball Finder, Nether Milgate, Ashford Road, Maidstone, Kent, ME14 4NN, Until you have returned the products to us, you must keep them in your possession and take reasonable care of them.


6. Warranties:
All products bought from our website are guaranteed against mechanical failure for 6 months from the date of purchase. If a product proves to be faulty within that period as a result of mechanical failure you may return it to us for an exchange. You must contact Customer Services and provide us with the original invoice, dispatch note or other proof of purchase.


7. Complaints and Liability:

If products we deliver to you are damaged, defective or not as ordered you should contact us within 14 days of delivery and we will replace the incorrect, damaged or defective products or make good any shortfall in quantity or at our discretion credit all costs charged to you on those products.

If you do not receive products ordered you should notify us within 28 days of the date of your order. We will deliver the products ordered or, at our option, credit the price and delivery charges of the non-delivered products unless your order was not accepted then we will re-notify of our non acceptance and the reason why.


8. Validity:
If any of these Terms and Conditions is unenforceable it shall not affect the enforceability of the rest of these Terms and Conditions.


9. Third Party Rights:
We may transfer our rights under the contract, but otherwise nothing in these Terms and Conditions shall give any person who is not a party to the contract any benefit or any right to enforce any of the terms of the contract.


10. Governing Law and Jurisdiction:
Your order and the formation of the contract shall be governed by and interpreted in accordance with English law.

The English Courts shall have jurisdiction to hear disputes between us.
